Regulations on Disciplinary Actions of the Communist Party of China.
Part One General Principles
Chapter One Guiding Ideology, Principles, and Scope of Application
Article One In order to uphold the Party Constitution and other internal Party regulations, maintain the Party's discipline, purify the Party's organization, safeguard the democratic rights of Party members, educate Party members to observe laws and regulations, maintain the Party's unity, and ensure the implementation of the Party's line, principles, policies, resolutions, and national laws and regulations, these regulations are formulated in accordance with the "Constitution of the Communist Party of China."
Article Two The construction of the Party's discipline must be guided by Marxism-Leninism, Mao Zedong Thought, Deng Xiaoping Theory, the important thought of the "Three Represents," the Scientific Outlook on Development, and Xi Jinping's Thought on Socialism with Chinese Characteristics for a New Era. It must adhere to and strengthen the Party's overall leadership, resolutely uphold General Secretary Xi Jinping's core position in the Party Central Committee and the whole Party, firmly maintain the authority and centralized unified leadership of the Party Central Committee, implement the overall requirements for Party building in the new era and the strategic deployment of strict governance over the Party, and comprehensively strengthen the construction of the Party's discipline.
Article Three The Party Constitution is the most fundamental internal Party regulation and the general rule for governing the Party. The Party's discipline is the behavioral rules that all levels of Party organizations and all Party members must abide by. Party organizations and members must firmly establish political awareness, overall awareness, core awareness, and alignment awareness, consciously abide by the Party Constitution, strictly implement and uphold the Party's discipline, consciously accept the constraints of the Party's discipline, and model compliance with national laws and regulations.
Article Four The work of disciplinary sanctions in the Party should adhere to the following principles:
(1) Adhere to the principle that the Party must manage the Party and strictly govern the Party in an all-round way. Strengthen the education, management, and supervision of all levels of Party organizations and all Party members, put discipline in the forefront, and focus on early intervention and small issues to prevent minor problems from escalating.
(2) Equality before Party discipline. Disciplinary actions against Party organizations and members who violate Party discipline must be serious and fair, and there should be no Party organization or member that is not subject to disciplinary constraints.
(3) Seek truth from facts. For the behaviors of Party organizations and members that violate Party discipline, they should be based on facts, with the Party Constitution, other internal Party regulations, and national laws and regulations as the criteria, accurately determine the nature of the violation, distinguish different situations, and handle them appropriately.
(4) Democratic centralism. The implementation of disciplinary sanctions should be decided collectively by the Party organization according to prescribed procedures, and no individual or small group is allowed to make decisions or approvals arbitrarily. The decisions made by higher-level Party organizations regarding the handling of Party organizations and members who violate Party discipline must be executed by lower-level Party organizations.
(5) Punish the past to prevent the future, and cure the illness to save the patient. When dealing with Party organizations and members who violate Party discipline, a combination of punishment and education should be implemented to achieve a balance between leniency and severity.
Article Five Utilize the "four forms" of supervision and discipline, regularly carry out criticism and self-criticism, and conduct interviews and inquiries, making "red faces and sweating" a norm; light disciplinary sanctions and organizational adjustments should become the majority of disciplinary actions; heavy disciplinary sanctions and major position adjustments should become the minority; and serious violations of discipline suspected of being illegal should become very few.
Article Six These regulations apply to Party organizations and members who should be held accountable for violations of Party discipline.
Chapter Two Violations and Disciplinary Sanctions
Article Seven Party organizations and members who violate the Party Constitution and other internal Party regulations, violate national laws and regulations, violate Party and national policies, violate socialist morality, and harm the interests of the Party, the country, and the people must be held accountable according to regulations.
Focus on investigating corruption cases that have not been restrained or stopped since the 18th National Congress of the Communist Party, where issues are concentrated and strongly reflected by the masses, and where political and economic issues are intertwined, as well as violations of the spirit of the Central Eight Regulations.
Article Eight Types of disciplinary sanctions for Party members:
(1) Warning;
(2) Serious warning;
(3) Revocation of Party positions;
(4) Observation of Party membership;
(5) Expulsion from the Party.
Article Nine For Party organizations that violate Party discipline, the higher-level Party organization should order them to make a self-examination or conduct a public criticism. For Party organizations that seriously violate Party discipline and cannot correct themselves, the higher-level Party committee, after verification, may take the following actions based on the severity of the circumstances:
(1) Reorganization;
(2) Dissolution.
Article Ten Party members who receive a warning sanction within one year or a serious warning sanction within one and a half years shall not be promoted within the Party or recommended for positions in external organizations that are higher than their original positions.
Article Eleven Revocation of Party positions is defined as the revocation of Party positions held by the sanctioned Party member that were elected or appointed by the Party. For those holding more than two positions within the Party, the Party organization should clarify whether to revoke all positions or one or several positions when making the sanction decision. If it is decided to revoke one position, the highest position held must be revoked. If it is decided to revoke more than two positions, revocation must start from the highest position held in order. For positions held in external organizations, it should be suggested that the external organization make corresponding handling according to regulations.
For those who should receive a revocation of Party positions but do not hold any Party positions, a serious warning sanction should be given. At the same time, for those holding positions in external organizations, it should be suggested that the external organization revoke their external positions.
Party members who receive a revocation of Party positions or a serious warning sanction according to the previous clause shall not hold or be recommended for positions within the Party or in external organizations that are equivalent to or higher than their original positions for two years.
Article Twelve The observation of Party membership sanction is divided into one year and two years of observation. For Party members who receive a one-year observation sanction, if they still do not meet the conditions for restoring Party member rights after the period, the observation period should be extended by one year. The maximum observation period should not exceed two years.
During the period of observation of Party membership, Party members do not have voting rights, election rights, or the right to be elected. If there are signs of repentance during the observation period, their Party member rights should be restored after the period; if they persist in not changing or if other violations of Party discipline are discovered, they should be expelled from the Party.
Party members who receive a sanction of observation of Party membership will automatically have their Party positions revoked. For those holding positions in external organizations, it should be suggested that the external organization revoke their external positions. Party members who have their Party member rights restored within two years after the observation of Party membership shall not hold or be recommended for positions within the Party or in external organizations that are equivalent to or higher than their original positions.
Article 13 Party members who are expelled from the party shall not be allowed to rejoin the party within five years, nor shall they be recommended for positions outside the party that are equivalent to or higher than their original positions. Those who are subject to other regulations prohibiting rejoining the party shall be handled according to those regulations.
Article 14 Representatives of the party's various levels of congress who are subject to disciplinary actions of observation or above (including observation) shall have their representative qualifications terminated by the party organization.
Article 15 For members of the leadership of party organizations that have been reorganized, in addition to being subject to the revocation of party positions or above (including revocation of party positions), they shall be automatically dismissed.
Article 16 For party members in organizations that have been dissolved, each member shall be reviewed individually. Those who meet the conditions for party membership shall be re-registered and participate in the new organization’s party life; those who do not meet the conditions for party membership shall be educated and given a deadline for correction. If they still do not change after education, they shall be persuaded to withdraw or expelled; those with disciplinary violations shall be investigated according to regulations.
Chapter 3 Rules for the Application of Disciplinary Sanctions
Article 17 In the following circumstances, a lighter or reduced sanction may be applied:
(1) Actively confessing issues for which one should be subject to party disciplinary sanctions;
(2) During the organization’s verification and case review process, cooperating with the verification and review work and truthfully explaining one’s own violations of discipline and law;
(3) Reporting co-defendants or others who should be subject to party disciplinary sanctions or legal accountability, and verified to be true;
(4) Actively recovering losses, eliminating adverse effects, or effectively preventing harmful results from occurring;
(5) Actively surrendering disciplinary gains;
(6) Having other meritorious performances.
Article 18 Depending on the special circumstances of the case, the Central Commission for Discipline Inspection may decide or may be decided by the provincial (ministerial) level discipline inspection commission (excluding the discipline inspection commission of sub-provincial cities) and reported to the Central Commission for Discipline Inspection for approval. For party members who violate discipline, sanctions may also be reduced beyond the scope specified in these regulations.
Article 19 Party members who violate party discipline should be given a warning or serious warning sanction. However, if they fall under one of the circumstances specified in Article 17 of these regulations or if there are other provisions in the specific provisions of these regulations, they may be given criticism and education, ordered to reflect, admonished, or organizationally handled, and exempted from party disciplinary sanctions. A written conclusion should be made for exempting disciplinary sanctions for violating party members.
Article 20 In the following circumstances, heavier or aggravated sanctions should be applied:
(1) Forcing or instigating others to violate discipline;
(2) Refusing to surrender or return disciplinary gains;
(3) After being sanctioned for violations, committing intentional violations that should be subject to party disciplinary sanctions;
(4) After being sanctioned for violations, being found to have committed violations before the sanction that should also be subject to party disciplinary sanctions;
(5) Other provisions specified in these regulations.
Article 21 A lighter sanction refers to giving a lighter sanction within the scope of sanctions that should be imposed for the disciplinary behavior specified in these regulations.
A heavier sanction refers to giving a heavier sanction within the scope of sanctions that should be imposed for the disciplinary behavior specified in these regulations.
Article 22 A reduced sanction refers to reducing one level of sanction beyond the scope of sanctions that should be imposed for the disciplinary behavior specified in these regulations.
An aggravated sanction refers to increasing one level of sanction beyond the scope of sanctions that should be imposed for the disciplinary behavior specified in these regulations.
For disciplinary behaviors specified in these regulations that only have one level of expulsion from the party, the provisions for reducing sanctions in the first paragraph do not apply.
Article 23 If a person has two or more (including two) disciplinary behaviors that should be subject to party disciplinary sanctions as specified in these regulations, they should be handled together, and the highest sanction among the various disciplinary behaviors should be increased by one level; if one of the disciplinary behaviors should be subject to expulsion from the party, expulsion from the party should be imposed.
Article 24 If a disciplinary behavior simultaneously violates two or more (including two) provisions of these regulations, it shall be handled according to the provision with the heavier sanction.
If all the elements of the disciplinary composition specified in one provision are included in the elements of the disciplinary composition specified in another provision, and the special provisions are inconsistent with the general provisions, the special provisions shall apply.
Article 25 If two or more (including two) persons jointly and intentionally violate discipline, the leader shall be given a heavier sanction, except as otherwise provided in these regulations; for other members, sanctions shall be given separately according to their roles and responsibilities in the joint violation.
For joint violations in economic matters, sanctions shall be given separately according to the amount of personal income and their roles. For the principal members of the disciplinary group, sanctions shall be imposed according to the total amount of the group’s violations; for other joint violators, if the circumstances are serious, sanctions shall be imposed according to the total amount of the joint violations.
Those who instigate others to violate discipline shall be held accountable for party disciplinary responsibility according to their roles in the joint violation.
Article 26 If the leadership of the party organization collectively makes a decision that violates party discipline or implements other acts that violate party discipline, members with common intent shall be handled according to the joint violation; for members who violate discipline due to negligence, sanctions shall be given separately according to their roles and responsibilities in the collective violation.
Chapter 4 Disciplinary Sanctions for Party Members Who Violate Laws and Commit Crimes
Article 27 If the party organization discovers during disciplinary review that a party member has committed acts of embezzlement, bribery, abuse of power, neglect of duty, rent-seeking, benefit transfer, favoritism, waste of state assets, and other violations of the law that are suspected of being criminal, they should be given sanctions of revocation of party positions, observation, or expulsion from the party.
Article 28 If the party organization discovers during disciplinary review that a party member has committed acts specified in the criminal law, which do not constitute a crime but must be held accountable for party discipline, or has other illegal acts that harm the interests of the party, the state, and the people, they should be given warnings up to expulsion from the party depending on the specific circumstances.
Article 29 If the party organization discovers during disciplinary review that a party member has seriously violated discipline and is suspected of committing a crime, a decision on party disciplinary sanctions should be made first in principle, and after giving administrative sanctions according to regulations, the case should be transferred to the relevant state organs for legal handling.
Article 30 If a party member is legally detained or arrested, the party organization shall suspend their voting rights, electoral rights, and other rights as a party member according to management authority. If the rights of the party member can be restored based on the results of the supervisory and judicial authorities, they shall be restored in a timely manner.
Article 31 If a party member's crime is minor, and the people's procuratorate lawfully decides not to prosecute, or the people's court lawfully issues a guilty verdict and exempts them from criminal punishment, they shall be given a penalty of revocation of party positions, probation within the party, or expulsion from the party.
If a party member commits a crime and is fined, they shall be dealt with according to the provisions of the previous paragraph.
Article 32 If a party member commits a crime and falls under any of the following circumstances, they shall be expelled from the party:
(1) If they are sentenced to the main penalty prescribed by criminal law (including a suspended sentence) for intentional crimes;
(2) If they are solely punished or additionally deprived of political rights;
(3) If they are sentenced to more than three years (not including three years) of fixed-term imprisonment for negligent crimes.
If a party member is sentenced to less than three years (including three years) of fixed-term imprisonment or is sentenced to control or detention for negligent crimes, they should generally be expelled from the party. For individuals who can be retained in the party, the party organization should seek approval from the next higher-level party organization in accordance with the provisions on the authority to approve penalties for party members.
Article 33 If a party member is criminally liable, the party organization shall impose party disciplinary penalties based on the effective judgments, rulings, decisions, and the established facts, nature, and circumstances recognized by the judicial authorities, and if they are public officials, corresponding administrative penalties shall be imposed by the supervisory authorities.
If a party member is subject to administrative penalties or administrative punishments, and party disciplinary responsibility should be pursued, the party organization may impose party disciplinary penalties or organizational handling according to the facts, nature, and circumstances established by the effective administrative penalties or administrative punishment decisions after verification.
If a party member violates national laws and regulations, or the rules of enterprises, institutions, or other social organizations and receives other disciplinary penalties, and party disciplinary responsibility should be pursued, the party organization shall impose party disciplinary penalties or organizational handling according to the verified facts, nature, and circumstances.
After the party organization makes a decision on party disciplinary penalties or organizational handling, if the judicial authorities, administrative authorities, etc., lawfully change the original effective judgments, rulings, decisions, etc., which affect the original party disciplinary penalties or organizational handling decisions, the party organization shall make corresponding handling based on the changed effective judgments, rulings, decisions, etc.
Chapter 5 Other Provisions
Article 34 If a probationary party member violates party discipline and the circumstances are relatively light, the party organization shall criticize and educate them or extend their probation period; if the circumstances are more serious, their probationary party member status shall be revoked.
Article 35 For party members who are missing after violating discipline, handling should be differentiated based on the situation:
(1) For those with serious disciplinary violations, the party organization shall make a decision to expel them from the party;
(2) Except for the circumstances specified in the previous item, if they have been missing for more than six months, the party organization shall expel them according to the provisions of the party constitution.
Article 36 If a party member who violates discipline dies before the party organization makes a penalty decision, or if serious disciplinary violations are discovered after their death, those who should be expelled from the party shall be expelled; for those who should receive penalties below probation within the party (including probation within the party), a written conclusion of the disciplinary violation and corresponding handling shall be made.
Article 37 Distinction of responsible personnel for disciplinary violations:
(1) Directly responsible persons refer to party members or party leaders who, within their scope of responsibility, fail to perform or incorrectly perform their duties, having a decisive impact on the losses or consequences caused.
(2) Major responsible persons refer to party leaders who, within their scope of responsibility, fail to perform or incorrectly perform their duties regarding directly supervised work, bearing direct leadership responsibility for the losses or consequences caused.
(3) Important responsible persons refer to party leaders who, within their scope of responsibility, fail to perform or incorrectly perform their duties regarding work they should manage or work they participate in deciding, bearing secondary leadership responsibility for the losses or consequences caused.
The responsible persons referred to in these regulations include major responsible persons and important responsible persons.
Article 38 The term "active confession" in these regulations refers to a party member suspected of violating discipline confessing their issues to the relevant organization before the initial investigation, or confessing issues not known to the organization during the initial investigation and case review.
Article 39 The calculation of economic losses mainly considers direct economic losses. Direct economic losses refer to the actual value of property losses that have a direct causal relationship with the disciplinary violations.
Article 40 Economic benefits obtained from disciplinary violations shall be confiscated or ordered to be returned.
For other benefits obtained from disciplinary violations, such as positions, titles, education, degrees, awards, qualifications, etc., the disciplinary inspection agency handling the case or its superior disciplinary inspection agency shall suggest that the relevant organizations, departments, or units correct them according to regulations.
For party members dealt with according to the provisions of Articles 35 and 36 of these regulations, if it is confirmed through investigation that they obtained benefits from disciplinary violations, they shall be handled according to the provisions of this article.
Article 41 After a decision on party disciplinary penalties is made, it shall be announced to all party members in the grassroots organization of the party to which the punished party member belongs and to the punished party member themselves within one month. If they are a member of the leadership team, it shall also be announced to the leadership team of the party organization they belong to, and the materials of the penalty decision shall be included in the file of the punished member according to the authority of cadre management and organizational relations; for those who receive penalties of revocation of party positions or above (including revocation of party positions), the corresponding procedures for changes in positions, salaries, work, and other related benefits shall also be handled within one month; if it involves the revocation or adjustment of their non-party positions, it shall be suggested that the non-party organization promptly revoke or adjust their non-party positions. In special circumstances, the organization that made or approved the penalty decision may approve an appropriate extension of the handling period. The maximum handling period shall not exceed six months.
Article 42 The agency executing the decision on party disciplinary penalties or the unit where the punished party member is located shall report the implementation of the penalty decision to the agency that made or approved the penalty decision within six months.
If a party member is dissatisfied with the party disciplinary penalty they received, they may file an appeal in accordance with the party constitution and relevant regulations.
Article 43 The general provisions of these regulations apply to other internal party regulations that have provisions for party disciplinary penalties, except for other internal party regulations issued or approved by the Central Committee of the Communist Party of China that have special provisions.
Part Two Special Provisions
Chapter 6 Penalties for Violations of Political Discipline
Article 44 If there is a lack of consistency with the Central Committee of the Party on major principle issues, and there are actual statements, actions, or adverse consequences, a warning or serious warning will be given; for more serious circumstances, the party position may be revoked or the individual may be placed under party observation; for severe circumstances, expulsion from the party will be imposed.
Article 45 If articles, speeches, declarations, or statements that adhere to the bourgeois liberalization stance, oppose the Four Basic Principles, and oppose the Party's reform and opening-up decisions are publicly published through the internet, radio, television, newspapers, flyers, books, etc., or through lectures, forums, report meetings, symposiums, etc., expulsion from the party will be imposed.
Publishing, broadcasting, printing, or publishing the articles, speeches, declarations, and statements listed in the previous paragraph, or providing convenient conditions for the aforementioned actions, will result in a serious warning or revocation of party position for those directly responsible and those in leadership; for severe circumstances, party observation or expulsion from the party will be imposed.
Article 46 Engaging in any of the following behaviors through the internet, radio, television, newspapers, flyers, books, etc., or through lectures, forums, report meetings, symposiums, etc., will result in a warning or serious warning for lighter circumstances; revocation of party position or party observation for more serious circumstances; and expulsion from the party for severe circumstances:
(1) Publicly publishing articles, speeches, declarations, or statements that violate the Four Basic Principles, distort the Party's reform and opening-up decisions, or have other serious political issues;
(2) Recklessly discussing the major policies of the Central Committee, undermining the Party's centralized unity;
(3) Disfiguring the image of the Party and the country, slandering or defaming Party and state leaders, heroes, and models, or distorting the history of the Party, the history of the People's Republic of China, and the history of the People's Army.
Publishing, broadcasting, printing, or publishing the contents listed in the previous paragraph, or providing convenient conditions for the aforementioned actions, will result in a serious warning or revocation of party position for those directly responsible and those in leadership; for severe circumstances, party observation or expulsion from the party will be imposed.
Article 47 Producing, selling, or disseminating books, audio-visual products, electronic publications, or online audio and video materials that contain any of the contents listed in Articles 45 and 46 will result in a warning or serious warning for lighter circumstances; revocation of party position or party observation for more serious circumstances; and expulsion from the party for severe circumstances.
Carrying or mailing books, audio-visual products, electronic publications, etc., that contain any of the contents listed in Articles 45 and 46 across borders without authorization will result in a warning or serious warning for more serious circumstances; and revocation of party position, party observation, or expulsion from the party for severe circumstances.
Article 48 Organizing secret groups within the Party or engaging in other activities that split the Party will result in expulsion from the party.
Participating in secret groups or engaging in other activities that split the Party will result in party observation or expulsion from the party.
Article 49 Engaging in non-organizational activities such as forming cliques, seeking personal gain, forming factions, or cultivating personal power within the Party, or obtaining political capital through activities like interest exchange or creating momentum for oneself, will result in a serious warning or revocation of party position; if it leads to a deterioration of the political ecology in the region, department, or unit, party observation or expulsion from the party will be imposed.
Article 50 If party leaders and cadres act independently in the areas they govern or departments they oversee, engage in factionalism, refuse to implement the major policies determined by the Central Committee, or even create their own set of policies behind the Central Committee's back, they will face revocation of party position, party observation, or expulsion from the party.
If the implementation of the Central Committee's decision-making and deployment is not resolute, if there are compromises or deviations that cause adverse political impacts or serious consequences, a warning or serious warning will be given; for severe circumstances, revocation of party position, party observation, or expulsion from the party will be imposed.
Article 51 Being disloyal and dishonest to the Party, being inconsistent in words and actions, pretending to comply while undermining, deceiving superiors and concealing from subordinates, being two-faced, and acting as a double agent will result in a warning or serious warning for lighter circumstances; revocation of party position or party observation for more serious circumstances; and expulsion from the party for severe circumstances.
Article 52 Manufacturing, spreading, or disseminating political rumors that undermine the unity of the Party will result in a warning or serious warning; for more serious circumstances, revocation of party position or party observation; and for severe circumstances, expulsion from the party.
If one has a bad political character, anonymously accuses others, intentionally frames others, or creates other rumors that cause damage or adverse effects, they will be dealt with according to the provisions of the previous paragraph.
Article 53 Making decisions on major policy issues that should be determined by the Central Committee or publicly expressing opinions without authorization will result in a serious warning or revocation of party position for those directly responsible and those in leadership; for severe circumstances, party observation or expulsion from the party will be imposed.
Article 54 Failing to report or seek approval from the organization for major matters according to relevant regulations will result in a warning or serious warning for more serious circumstances; and revocation of party position or party observation for severe circumstances.
Article 55 Interfering with inspection work or failing to implement inspection rectification requirements will result in a warning or serious warning for lighter circumstances; revocation of party position or party observation for more serious circumstances; and expulsion from the party for severe circumstances.
Article 56 Resisting organizational review, and engaging in any of the following behaviors will result in a warning or serious warning; for more serious circumstances, revocation of party position or party observation; and for severe circumstances, expulsion from the party:
(1) Colluding to provide false testimony or fabricating, destroying, transferring, or concealing evidence;
(2) Preventing others from exposing or reporting, or providing evidence materials;
(3) Shielding co-defendants;
(4) Providing false information to the organization to cover up the facts;
(5) Engaging in other behaviors that resist organizational review.
Article 57 Organizing or participating in gatherings, parades, demonstrations, etc., that oppose the Party's basic theories, basic lines, basic strategies, or major policies, or opposing the Party's basic theories, basic lines, basic strategies, or major policies through organizing lectures, forums, report meetings, symposiums, etc., causing serious adverse effects, will result in expulsion from the party for planners, organizers, and key members.
For other participants or those who support the above activities by providing information, materials, property, venues, etc., those with lighter circumstances will receive a warning or a serious warning; those with more serious circumstances will have their party positions revoked or be placed under party observation; those with severe circumstances will be expelled from the party.
For those who participated under coercion without understanding the truth, if they show signs of repentance after criticism and education, they may be exempted from punishment or not punished.
Participating in other gatherings, parades, demonstrations, etc., without organizational approval, those with lighter circumstances will receive a warning or a serious warning; those with more serious circumstances will have their party positions revoked or be placed under party observation; those with severe circumstances will be expelled from the party.
Article 58 Those who organize or participate in organizations aimed at opposing the party's leadership, opposing the socialist system, or being hostile to the government, the planners, organizers, and key members will be expelled from the party.
For other participants, those with lighter circumstances will receive a warning or a serious warning; those with more serious circumstances will have their party positions revoked or be placed under party observation; those with severe circumstances will be expelled from the party.
Article 59 Those who organize or participate in cults or evil cult organizations, the planners, organizers, and key members will be expelled from the party.
For other participants, those with lighter circumstances will receive a warning or a serious warning; those with more serious circumstances will have their party positions revoked or be placed under party observation; those with severe circumstances will be expelled from the party.
For participants who do not understand the truth, if they show signs of repentance after criticism and education, they may be exempted from punishment or not punished.

For those who participated under coercion without understanding the truth, if they show signs of repentance after criticism and education, they may be exempted from punishment or not punished.
For other behaviors that violate the party and national ethnic policies, those with lighter circumstances will receive a warning or a serious warning; those with more serious circumstances will have their party positions revoked or be placed under party observation; those with severe circumstances will be expelled from the party.
Article 61 Those who organize and use religious activities to oppose the party's line, principles, policies, and resolutions, and undermine national unity, the planners, organizers, and key members will be expelled from the party.
For other participants, they will have their party positions revoked or be placed under party observation; those with severe circumstances will be expelled from the party.
For those who participated under coercion without understanding the truth, if they show signs of repentance after criticism and education, they may be exempted from punishment or not punished.
For other behaviors that violate the party and national religious policies, those with lighter circumstances will receive a warning or a serious warning; those with more serious circumstances will have their party positions revoked or be placed under party observation; those with severe circumstances will be expelled from the party.
Article 62 For party members who believe in religion, ideological education should be strengthened. If they still do not change after the party organization helps educate them, they should be advised to withdraw from the party; those who refuse to withdraw will be expelled; those who participate in inciting activities using religion will be expelled from the party.
Article 63 Those who organize superstitious activities will have their party positions revoked or be placed under party observation; those with severe circumstances will be expelled from the party.
Participating in superstitious activities that cause adverse effects will receive a warning or a serious warning; those with more serious circumstances will have their party positions revoked or be placed under party observation; those with severe circumstances will be expelled from the party.
For participants who do not understand the truth, if they show signs of repentance after criticism and education, they may be exempted from punishment or not punished.
Article 64 Those who organize and use clan forces to confront the party and government, hinder the implementation of the party and national policies and decision-making, or undermine the construction of the party's grassroots organizations, the planners, organizers, and key members will be expelled from the party.
For other participants, they will have their party positions revoked or be placed under party observation; those with severe circumstances will be expelled from the party.
For those who participated under coercion without understanding the truth, if they show signs of repentance after criticism and education, they may be exempted from punishment or not punished.
Article 65 Those who apply for political asylum in foreign countries or embassies (consulates) in China after violating discipline, or flee to foreign countries or embassies (consulates) in China after violating discipline, will be expelled from the party.
Those who publicly publish articles, speeches, declarations, statements, etc., opposing the party and government abroad will be dealt with according to the previous provisions.
Those who intentionally provide convenient conditions for the above behaviors will receive party observation or expulsion from the party.
Article 66 In foreign-related activities, if their words and actions cause a serious political impact, damaging the dignity and interests of the party and the country, they will have their party positions revoked or be placed under party observation; those with severe circumstances will be expelled from the party.
Article 67 Those who do not fulfill the main responsibility and supervisory responsibility for strict party governance, or do not effectively fulfill the main responsibility and supervisory responsibility for strict party governance, causing serious damage or adverse effects to the party organization, will receive a warning or a serious warning for those directly responsible and those in leadership positions; those with severe circumstances will have their party positions revoked or be placed under party observation.
Article 68 Party leaders who do not report, resist, or struggle against erroneous thoughts and behaviors that violate political discipline and political rules, neglect their duties, and create adverse effects will receive a warning or a serious warning; those with severe circumstances will have their party positions revoked or be placed under party observation.
Article 69 Violating the party's fine traditions and work practices, causing adverse political effects, will receive a warning or a serious warning; those with more serious circumstances will have their party positions revoked or be placed under party observation; those with severe circumstances will be expelled from the party.
Chapter 7 Disciplinary actions for violations of organizational discipline.
Article 70 Violating the principle of democratic centralism, those who have any of the following behaviors will receive a warning or a serious warning; those with severe circumstances will have their party positions revoked or be placed under party observation:
(1) Refusing to implement or unilaterally changing major decisions made by the party organization;
(2) Violating discussion rules, with individuals or a minority deciding major issues;
(3) Intentionally evading collective decision-making, deciding major matters, important personnel appointments and removals, important project arrangements, and large fund usage;
(4) Violating regulations collectively under the guise of collective decision-making.
Article 71 If lower-level party organizations refuse to implement or unilaterally change decisions made by higher-level party organizations, those directly responsible and those in leadership positions will receive a warning or a serious warning; those with severe circumstances will have their party positions revoked or be placed under party observation.
Article 72 Refusing to implement decisions regarding allocation, transfer, exchange, etc., made by the party organization will receive a warning, serious warning, or revocation of party positions.
In special periods or emergencies, refusing to implement decisions made by the party organization will result in party observation or expulsion from the party.
Article 73 Those who engage in any of the following behaviors, with serious circumstances, shall be given a warning or a serious warning:
(1) Violating the regulations on reporting personal matters and concealing or failing to report;
(2) Failing to truthfully explain issues to the organization during conversations or inquiries conducted by the organization;
(3) Failing to report personal whereabouts as required or failing to report truthfully;
(4) Failing to truthfully fill out personal archive information.
Those who tamper with or forge personal archive information shall receive a serious warning; if the circumstances are severe, they shall be dismissed from their party positions or placed under party observation.
Concealing serious errors before joining the party shall generally result in expulsion; for those who perform well after joining the party, a serious warning, dismissal from party positions, or placement under party observation shall be given.
Article 74 Party members and leading cadres who violate relevant regulations by organizing or participating in spontaneously established associations such as hometown associations, alumni associations, or comrades' associations, with serious circumstances, shall receive a warning, serious warning, or dismissal from party positions.
Article 75 Those who engage in any of the following behaviors shall receive a warning or serious warning; if the circumstances are serious, they shall be dismissed from party positions or placed under party observation; if the circumstances are severe, they shall be expelled from the party:
(1) Engaging in non-organizational activities such as vote-buying or assisting in elections during democratic recommendations, evaluations, organizational investigations, and internal party elections;
(2) Violating organizational principles to engage in non-organizational activities during legally mandated voting or election activities, organizing, inciting, or inducing others to vote or make decisions;
(3) Engaging in other activities that violate the party constitution, other internal party regulations, and relevant rules during elections.
Engaging in organized vote-buying or using public funds for vote-buying shall result in heavier or aggravated penalties.
Article 76 In the work of selecting and appointing cadres, behaviors that violate regulations such as nepotism, exclusion of dissenters, promising positions, intervening through personal connections, seeking positions, or sudden promotions or adjustments of cadres shall result in warnings or serious warnings for those directly responsible and those in leadership positions if the circumstances are light; if the circumstances are serious, they shall be dismissed from party positions or placed under party observation; if the circumstances are severe, they shall be expelled from the party.
If serious consequences arise from negligence or mistakes in personnel management, those directly responsible and those in leadership positions shall be dealt with according to the provisions of the previous paragraph.
Article 77 In the recruitment, assessment, promotion, title evaluation of cadres and employees, and in the work of conscription and placement of demobilized soldiers, if one conceals or distorts the truth, or uses their power or influence to violate relevant regulations to seek benefits for themselves or others, they shall receive a warning or serious warning; if the circumstances are serious, they shall be dismissed from party positions or placed under party observation; if the circumstances are severe, they shall be expelled from the party.
Engaging in fraud to obtain positions, ranks, titles, benefits, qualifications, education, degrees, honors, or other interests shall be dealt with according to the provisions of the previous paragraph.
Article 78 Violating the voting rights, election rights, and eligibility rights of party members, with serious circumstances, shall result in a warning or serious warning; if the circumstances are severe, they shall be dismissed from party positions.
Using coercion, threats, deception, or inducement to obstruct party members from exercising their voting rights, election rights, and eligibility rights shall result in dismissal from party positions, placement under party observation, or expulsion from the party.
Article 79 Those who engage in any of the following behaviors shall receive a warning or serious warning; if the circumstances are serious, they shall be dismissed from party positions or placed under party observation; if the circumstances are severe, they shall be expelled from the party:
(1) Obstructing or suppressing criticism, reporting, or accusations, or privately withholding, destroying, or intentionally leaking criticism, reporting, or accusation materials to others;
(2) Suppressing party members' defenses, testimonies, etc., resulting in adverse consequences;
(3) Suppressing party members' appeals, resulting in adverse consequences, or failing to handle party members' appeals according to relevant regulations;
(4) Engaging in other behaviors that infringe upon the rights of party members, resulting in adverse consequences.
Those who retaliate against critics, reporters, accusers, witnesses, and others shall receive heavier or aggravated penalties.
If the party organization engages in the above behaviors, those directly responsible and those in leadership positions shall be dealt with according to the provisions of the first paragraph.
Article 80 Violating the provisions of the party constitution and other internal party regulations by using fraud or other means to develop individuals who do not meet the conditions for party membership into party members, or issuing party membership certificates to non-party members, shall result in a warning or serious warning for those directly responsible and those in leadership positions; if the circumstances are severe, they shall be dismissed from party positions.
Violating relevant procedural regulations to develop party members shall result in those directly responsible and those in leadership positions being dealt with according to the provisions of the previous paragraph.
Article 81 Violating relevant regulations to obtain foreign nationality or acquire permanent residency or long-term residence permits abroad shall result in dismissal from party positions, placement under party observation, or expulsion from the party.
Article 82 Violating relevant regulations to handle personal exit (entry) documents, or traveling to Hong Kong and Macau without approval, if the circumstances are light, shall result in a warning or serious warning; if the circumstances are serious, they shall be dismissed from party positions; if the circumstances are severe, they shall be placed under party observation.
Article 83 Party members in overseas institutions or temporary overseas groups who leave the organization without authorization, or party members engaged in foreign affairs, confidential, military, and other work who violate relevant regulations to contact and interact with foreign institutions or personnel, shall receive a warning, serious warning, or dismissal from party positions.
Article 84 Party members in overseas institutions or temporary overseas groups who leave the organization for less than six months and then return voluntarily shall be dismissed from party positions or placed under party observation; those who leave the organization for more than six months shall be treated as voluntarily leaving the party and shall be expelled from the party.
Deliberately providing convenience for others to leave the organization shall result in a warning, serious warning, or dismissal from party positions.
Chapter Eight Penalties for Violating Integrity Discipline.
Article 85 Party members and cadres must correctly exercise the power granted by the people, maintain integrity and honesty, and oppose any abuse of power or actions seeking personal gain.
Using one's power or influence to seek benefits for others, receiving property from one's spouse, children, and their spouses, and other relatives and specific related persons, if the circumstances are serious, a warning or serious warning will be given; if the circumstances are severe, the party position will be revoked, the party will be under observation, or expulsion from the party will be imposed.
Article 86 If one uses their power or influence to seek benefits for each other and their spouses, children, and their spouses, as well as relatives, staff around them, and other specific related persons, engaging in power trading, a warning or serious warning will be given; if the circumstances are serious, the party position will be revoked or the party will be under observation; if the circumstances are severe, expulsion from the party will be imposed.
Article 87 If one condones or tacitly allows their spouse, children, and their spouses, as well as relatives, staff around them, and other specific related persons to use the power or influence of the party member and cadre for personal gain, if the circumstances are light, a warning or serious warning will be given; if the circumstances are serious, the party position will be revoked or the party will be under observation; if the circumstances are severe, expulsion from the party will be imposed.
The spouse, children, and their spouses, as well as other relatives and specific related persons of party members and cadres, who do not actually work but receive salaries, or who do work but receive salaries significantly exceeding the standard for the same position, if the party member and cadre are aware and do not correct it, will be handled according to the previous provisions.
Article 88 Accepting gifts, cash, consumption cards, and other valuables that may affect the impartial execution of public duties, if the circumstances are light, a warning or serious warning will be given; if the circumstances are serious, the party position will be revoked or the party will be under observation; if the circumstances are severe, expulsion from the party will be imposed.
Receiving other valuables that are obviously beyond normal gift-giving will be handled according to the previous provisions.
Article 89 Giving gifts, cash, consumption cards, and other valuables that are obviously beyond normal gift-giving to public officials and their spouses, children, and their spouses, as well as relatives and other specific related persons, if the circumstances are serious, a warning or serious warning will be given; if the circumstances are severe, the party position will be revoked or the party will be under observation.
Article 90 Borrowing money, housing, vehicles, etc., from management and service objects, affecting the impartial execution of public duties, if the circumstances are serious, a warning or serious warning will be given; if the circumstances are severe, the party position will be revoked, the party will be under observation, or expulsion from the party will be imposed.
Engaging in financial activities such as private lending to obtain large returns, affecting the impartial execution of public duties, will be handled according to the previous provisions.
Article 91 Using power or influence to handle wedding, funeral, and celebratory matters, causing a negative impact on society, a warning or serious warning will be given; if the circumstances are severe, the party position will be revoked; if one takes the opportunity to profit or engages in other actions that infringe on the interests of the state, collective, and people, a heavier or aggravated punishment will be imposed, up to expulsion from the party.
Article 92 Accepting or providing invitations or arrangements for travel, fitness, entertainment, etc., that may affect the impartial execution of public duties, if the circumstances are serious, a warning or serious warning will be given; if the circumstances are severe, the party position will be revoked or the party will be under observation.
Article 93 Violating relevant regulations to obtain, hold, or use various consumption cards such as sports fitness cards, club and association membership cards, golf cards, or violating relevant regulations to enter private clubs, if the circumstances are serious, a warning or serious warning will be given; if the circumstances are severe, the party position will be revoked or the party will be under observation.
Article 94 Violating relevant regulations to engage in profit-making activities, if any of the following behaviors occur, if the circumstances are light, a warning or serious warning will be given; if the circumstances are serious, the party position will be revoked or the party will be under observation; if the circumstances are severe, expulsion from the party will be imposed:
(1) Engaging in business or running a company;
(2) Holding shares or securities of unlisted companies (enterprises);
(3) Buying and selling stocks or engaging in other securities investments;
(4) Engaging in paid intermediary activities;
(5) Registering a company or investing abroad;
(6) Engaging in other profit-making activities that violate relevant regulations.
Using information obtained during decision-making and approval processes related to enterprise restructuring, targeted issuance, mergers and acquisitions, land use rights transfer, etc., to buy and sell stocks, or using power or influence to obtain abnormal profits through purchasing trust products, funds, etc., will be handled according to the previous provisions.
Violating relevant regulations to hold part-time jobs in economic organizations, social organizations, etc., or obtaining additional benefits such as salaries, bonuses, and allowances while approved for part-time jobs, will be handled according to the first provision.
Article 95 Using power or influence to seek benefits for spouses, children, and their spouses, as well as other relatives and specific related persons in areas such as approval supervision, resource development, financial credit, bulk purchasing, land use rights transfer, real estate development, engineering bidding, and public financial expenditure, if the circumstances are light, a warning or serious warning will be given; if the circumstances are serious, the party position will be revoked or the party will be under observation; if the circumstances are severe, expulsion from the party will be imposed.
Using power or influence to assist spouses, children, and their spouses, as well as other relatives and specific related persons in attracting deposits, promoting financial products, etc., will be handled according to the previous provisions.
Article 96 Party leaders and cadres who violate relevant regulations after leaving office or retiring, accepting appointments from enterprises and intermediary organizations within the jurisdiction of their original positions, or engaging in profit-making activities related to the business scope of their original positions, if the circumstances are light, a warning or serious warning will be given; if the circumstances are serious, the party position will be revoked; if the circumstances are severe, the party will be under observation.
Party leaders and cadres who violate relevant regulations after leaving office or retiring and serve as independent directors, independent supervisors, etc., in listed companies or fund management companies, if the circumstances are light, a warning or serious warning will be given; if the circumstances are serious, the party position will be revoked; if the circumstances are severe, the party will be under observation.
Article 97 The spouses, children, and their spouses of party leaders and cadres who violate relevant regulations by engaging in business activities that may affect the impartial execution of public duties within the jurisdiction and business scope of the party leader and cadre, or who hold senior positions appointed or hired by foreign parties in foreign-funded enterprises or Sino-foreign joint ventures within the jurisdiction and business scope of the party leader and cadre, or who violate regulations by holding concurrent positions or receiving remuneration, shall be corrected by the party leader and cadre according to regulations; if they refuse to correct, they shall resign from their current position or be adjusted by the organization; if they do not resign or do not comply with the organizational adjustment, they shall be given a disciplinary sanction of revocation of party positions.
Article 98 If party and state organs violate relevant regulations to engage in business operations, those directly responsible and those in leadership positions shall be given a warning or serious warning sanction; if the circumstances are serious, they shall be given a disciplinary sanction of revocation of party positions.
Article 99 If party leaders and cadres violate work and living security systems, seeking special treatment for themselves, their spouses, children, and their spouses, and other relatives and specific relations in transportation, medical care, security, etc., and the circumstances are relatively serious, they shall be given a warning or serious warning sanction; if the circumstances are severe, they shall be given a disciplinary sanction of revocation of party positions or observation within the party.
Article 100 If they infringe on national and collective interests in the allocation and purchase of housing, and the circumstances are relatively light, they shall be given a warning or serious warning sanction; if the circumstances are relatively serious, they shall be given a disciplinary sanction of revocation of party positions or observation within the party; if the circumstances are severe, they shall be given a disciplinary sanction of expulsion from the party.
Article 101 If they use their power or influence from their position to occupy public and private property not managed by themselves, or occupy public and private property by symbolically paying money, or receive services or use labor without compensation or by symbolically paying remuneration, and the circumstances are relatively light, they shall be given a warning or serious warning sanction; if the circumstances are relatively serious, they shall be given a disciplinary sanction of revocation of party positions or observation within the party; if the circumstances are severe, they shall be given a disciplinary sanction of expulsion from the party.
If they use their power or influence from their position to have expenses that should be paid by themselves for themselves, their spouses, children, and their spouses, and other relatives paid or reimbursed by subordinate units, other units, or others, they shall be handled according to the provisions of the previous paragraph.
Article 102 If they use their power or influence from their position to occupy public property for personal use in violation of relevant regulations for more than six months, and the circumstances are relatively serious, they shall be given a warning or serious warning sanction; if the circumstances are severe, they shall be given a disciplinary sanction of revocation of party positions.
If they occupy public property for profit-making activities, they shall be given a warning or serious warning sanction; if the circumstances are relatively serious, they shall be given a disciplinary sanction of revocation of party positions or observation within the party; if the circumstances are severe, they shall be given a disciplinary sanction of expulsion from the party.
If they lend public property to others for profit-making activities, they shall be handled according to the provisions of the previous paragraph.
Article 103 If they violate relevant regulations to organize or participate in banquets, high-consumption entertainment, fitness activities paid for with public funds, or use public funds to purchase, give, or distribute gifts, consumption cards (vouchers), etc., those directly responsible and those in leadership positions, if the circumstances are relatively light, shall be given a warning or serious warning sanction; if the circumstances are relatively serious, they shall be given a disciplinary sanction of revocation of party positions or observation within the party; if the circumstances are severe, they shall be given a disciplinary sanction of expulsion from the party.
Article 104 If they violate relevant regulations to set their own salaries or abuse allowances, subsidies, bonuses, etc., those directly responsible and those in leadership positions, if the circumstances are relatively light, shall be given a warning or serious warning sanction; if the circumstances are relatively serious, they shall be given a disciplinary sanction of revocation of party positions or observation within the party; if the circumstances are severe, they shall be given a disciplinary sanction of expulsion from the party.
Article 105 If they have any of the following behaviors, those directly responsible and those in leadership positions, if the circumstances are relatively light, shall be given a warning or serious warning sanction; if the circumstances are relatively serious, they shall be given a disciplinary sanction of revocation of party positions or observation within the party; if the circumstances are severe, they shall be given a disciplinary sanction of expulsion from the party:
(1) Traveling on public funds or disguising public-funded travel under the guise of study training, investigation research, or employee recuperation;
(2) Changing official travel itineraries to take the opportunity to travel;
(3) Participating in investigation activities organized by managed enterprises or subordinate units to take the opportunity to travel.
Disguising public-funded overseas travel under the guise of investigation, study, training, discussion, investment promotion, exhibition, etc., shall be handled according to the provisions of the previous paragraph.
Article 106 If they violate public reception management regulations, exceeding standards and scope of reception or taking the opportunity to indulge in excessive eating and drinking, those directly responsible and those in leadership positions, if the circumstances are relatively serious, shall be given a warning or serious warning sanction; if the circumstances are severe, they shall be given a disciplinary sanction of revocation of party positions.
Article 107 If they violate relevant regulations in equipping, purchasing, replacing, decorating, or using public transportation tools or have other behaviors that violate public transportation management regulations, those directly responsible and those in leadership positions, if the circumstances are relatively serious, shall be given a warning or serious warning sanction; if the circumstances are severe, they shall be given a disciplinary sanction of revocation of party positions or observation within the party.
Article 108 If they violate meeting activity management regulations and have any of the following behaviors, those directly responsible and those in leadership positions, if the circumstances are relatively serious, shall be given a warning or serious warning sanction; if the circumstances are severe, they shall be given a disciplinary sanction of revocation of party positions:
(1) Holding meetings in scenic areas where meetings are prohibited;
(2) Deciding or approving the holding of various festivals, celebrations, and activities.
If they hold evaluation and recognition activities without authorization or charge fees under the guise of evaluation and recognition activities, they shall be handled according to the provisions of the previous paragraph.
Article 109 If they violate office space management regulations and have any of the following behaviors, those directly responsible and those in leadership positions, if the circumstances are relatively serious, shall be given a warning or serious warning sanction; if the circumstances are severe, they shall be given a disciplinary sanction of revocation of party positions:
(1) Deciding or approving the construction or renovation of office buildings, training centers, and other venues;
(2) Exceeding standards in equipping and using office space;
(3) Using public funds to rent or occupy guest rooms or other places for personal use.
Article 110 Engaging in power-for-sex transactions or using property to engage in money-for-sex transactions shall result in a warning or serious warning sanction; if the circumstances are relatively serious, they shall be given a disciplinary sanction of revocation of party positions or observation within the party; if the circumstances are severe, they shall be given a disciplinary sanction of expulsion from the party.
Article 111 If there are other behaviors that violate integrity discipline regulations, they shall be given a warning up to expulsion from the party depending on the specific circumstances.
Chapter 9 Disciplinary actions for violations of mass discipline.
Article 112 Those who have one of the following behaviors shall be given a warning or serious warning punishment for those directly responsible and those in leadership positions if the circumstances are relatively light; if the circumstances are more serious, they shall be given a revocation of party positions or a probationary observation within the party; if the circumstances are severe, they shall be expelled from the party:
(1) Raising funds, labor, or imposing costs on the masses beyond standards and scope, increasing the burden on the masses;
(2) Violating relevant regulations to withhold or confiscate the property or punish the masses;
(3) Withholding the property of the masses or violating relevant regulations to delay payments to the masses;
(4) Collecting fees in violation of relevant regulations during management and service activities;
(5) Creating difficulties for the masses or engaging in extortion during the handling of matters involving the masses;
(6) Engaging in other behaviors that harm the interests of the masses.
In the field of poverty alleviation, those who have the above behaviors shall be punished more severely or with increased penalties.
Article 113 Interfering with the autonomy of production and operation, resulting in significant losses to the property of the masses, shall result in a warning or serious warning punishment for those directly responsible and those in leadership positions; if the circumstances are serious, they shall be given a revocation of party positions or a probationary observation within the party.
Article 114 In matters such as social security, policy support, poverty alleviation, and distribution of disaster relief funds, favoritism and obvious unfairness shall result in a warning or serious warning punishment; if the circumstances are relatively serious, they shall be given a revocation of party positions or a probationary observation within the party; if the circumstances are severe, they shall be expelled from the party.
Article 115 Using clan or organized crime to oppress the masses, or condoning criminal activities and acting as a "protective umbrella" for organized crime, shall result in a revocation of party positions or a probationary observation within the party; if the circumstances are severe, they shall be expelled from the party.
Article 116 Those who have one of the following behaviors shall be given a warning or serious warning punishment for those directly responsible and those in leadership positions if the circumstances are relatively serious; if the circumstances are severe, they shall be given a revocation of party positions or a probationary observation within the party:
(1) Failing to timely resolve issues related to the production and living interests of the masses that can be solved according to policies or relevant regulations, being lazy and ineffective, causing adverse effects;
(2) Passively responding to and shirking responsibilities for the legitimate demands of the masses, damaging the relationship between the party and the masses, and between officials and the masses;
(3) Having a bad attitude towards the masses, being rude and brutal, causing adverse effects;
(4) Falsifying information, deceiving superiors and hiding the truth, harming the interests of the masses;
(5) Engaging in other acts of inaction or misconduct that harm the interests of the masses.
Article 117 Blindly incurring debts, expanding operations, and launching projects that waste resources and harm the people, resulting in significant losses to national, collective, or mass property and interests, shall result in a warning or serious warning punishment for those directly responsible and those in leadership positions; if the circumstances are severe, they shall be given a revocation of party positions, probationary observation within the party, or expulsion from the party.
Article 118 When national property and the lives and property of the masses are seriously threatened, failing to rescue when able, if the circumstances are relatively serious, shall result in a warning, serious warning, or revocation of party positions; if the circumstances are severe, they shall be given probationary observation within the party or expelled from the party.
Article 119 Failing to publicly disclose party affairs, government affairs, factory affairs, village (community) affairs, etc., as required, infringing on the right of the masses to know, shall result in a warning or serious warning punishment for those directly responsible and those in leadership positions if the circumstances are relatively serious; if the circumstances are severe, they shall be given a revocation of party positions or a probationary observation within the party.
Article 120 Other behaviors that violate the discipline of the masses shall be punished with warnings up to expulsion from the party, depending on the specific circumstances.
Chapter 10 Disciplinary Actions for Violating Work Discipline
Article 121 Being irresponsible or negligent in management during work, failing to effectively implement, inspect, and supervise the implementation of superior decision-making deployments, causing significant losses to the party, the state, the people, and public property, shall result in a warning or serious warning punishment for those directly responsible and those in leadership positions; if significant losses occur, they shall be given a revocation of party positions, probationary observation within the party, or expulsion from the party.
Failing to effectively implement the development concepts of innovation, coordination, green, openness, and sharing, being negligent in responsibilities, causing significant or major losses, shall result in increased or more severe penalties.
Article 122 Those who have one of the following behaviors, causing serious adverse effects, shall be given a warning or serious warning punishment for those directly responsible and those in leadership positions if the circumstances are relatively light; if the circumstances are more serious, they shall be given a revocation of party positions or a probationary observation within the party; if the circumstances are severe, they shall be expelled from the party:
(1) Only expressing support for the decisions and deployments of the Central Committee without implementing them;
(2) Being keen on creating public opinion and being superficial;
(3) Simply implementing meetings with meetings and documents with documents, without taking action in actual work;
(4) Engaging in other forms of formalism and bureaucratism in work.
Article 123 Party organizations that have one of the following behaviors shall be given a warning or serious warning punishment for those directly responsible and those in leadership positions if the circumstances are relatively serious; if the circumstances are severe, they shall be given a revocation of party positions or a probationary observation within the party:
(1) After a party member is sentenced to criminal punishment according to law, failing to impose party disciplinary punishment as required, or failing to impose party disciplinary punishment for behaviors that violate national laws and regulations;
(2) After a decision on party disciplinary punishment or a decision on appeal review is made, failing to implement the matters regarding the party membership, positions, ranks, and treatment of the punished person as required;
(3) After a party member is subjected to party disciplinary punishment, failing to carry out daily education, management, and supervision of the punished party member according to the authority of cadre management and organizational relationships.
Article 124 If a person under management defects due to irresponsibility at work, those directly responsible and those in leadership positions shall be given a warning or serious warning punishment; if the circumstances are severe, they shall be given a revocation of party positions.
If a person under management leaves due to irresponsibility at work, those directly responsible and those in leadership positions shall be given a warning or serious warning punishment if the circumstances are relatively serious; if the circumstances are severe, they shall be given a revocation of party positions.
Article 125 When reporting or presenting work to superiors during inspections or checks, if matters that should be reported are not reported or not reported truthfully, causing serious damage or serious adverse effects, a warning or serious warning shall be given to the directly responsible person and the responsible leader; in severe cases, the party position may be revoked or the person may be placed under party observation.
During inspections or checks by superiors, if subordinates are indulged, instigated, hinted, or forced to lie or report false information, heavier or aggravated penalties shall be imposed.
Article 126 Party members and leading cadres who violate relevant regulations by intervening in and interfering with market economic activities, and engage in any of the following behaviors that cause adverse effects, shall be given a warning or serious warning; for more serious circumstances, they shall be dismissed from their party positions or placed under party observation; for severe circumstances, they shall be expelled from the party:
(1) Intervening in and interfering with activities such as the contracting and bidding of construction projects, land use rights transfer, government procurement, real estate development and operation, mineral resource development and utilization, and intermediary services;
(2) Intervening in and interfering with matters such as the restructuring and reform of state-owned enterprises, mergers, bankruptcies, property transactions, asset verification, asset evaluation, asset transfer, major project investments, and other significant business activities;
(3) Intervening in and interfering with the approval of various administrative licenses and funding loans;
(4) Intervening in and interfering with economic disputes;
(5) Intervening in and interfering with the use, distribution, contracting, leasing, and other matters related to collective funds, assets, and resources.
Article 127 Party members and leading cadres who violate relevant regulations by intervening in and interfering with judicial activities and disciplinary enforcement activities, inquiring about case details from relevant localities or departments, making calls, or using other means to influence judicial activities and disciplinary enforcement activities, shall receive a serious warning for lighter circumstances; for more serious circumstances, they shall be dismissed from their party positions or placed under party observation; for severe circumstances, they shall be expelled from the party.
Party members and leading cadres who violate relevant regulations by intervening in and interfering with the allocation of public financial funds, project approval reviews, government awards and commendations, causing significant losses or adverse effects, shall be dealt with according to the provisions of the previous paragraph.
Article 128 Leaking, spreading, inquiring about, or stealing confidential matters related to the selection and appointment of cadres, disciplinary reviews, inspections, and other undisclosed matters of the party organization, shall result in a warning or serious warning; for more serious circumstances, they shall be dismissed from their party positions or placed under party observation; for severe circumstances, they shall be expelled from the party.
Privately retaining materials related to the selection and appointment of cadres, disciplinary reviews, inspections, and other aspects, for more serious circumstances, shall result in a warning or serious warning; for severe circumstances, they shall be dismissed from their party positions.
Article 129 In examinations and admissions, if there are violations of relevant regulations such as leaking exam questions, cheating in the examination room, altering exam papers, or illegal admissions, a warning or serious warning shall be given; for more serious circumstances, they shall be dismissed from their party positions or placed under party observation; for severe circumstances, they shall be expelled from the party.
Article 130 Seeking to use public funds for personal or others' overseas trips in an improper manner, for lighter circumstances, a warning shall be given; for more serious circumstances, a serious warning shall be given; for severe circumstances, they shall be dismissed from their party positions.
Article 131 Party members in temporary overseas groups or personnel who unilaterally extend their stay abroad or change their itinerary without authorization shall receive a warning or serious warning; for severe circumstances, they shall be dismissed from their party positions.
Article 132 Party members in overseas institutions or temporary overseas groups who violate the laws and regulations of the host country or region, or do not respect the religious customs of the host country or region, shall receive a warning or serious warning for more serious circumstances; for severe circumstances, they shall be dismissed from their party positions, placed under party observation, or expelled from the party.
Article 133 In the party's disciplinary inspection, organization, propaganda, united front work, and other work, if duties are not fulfilled or are incorrectly fulfilled, causing losses or adverse effects, a warning up to expulsion from the party shall be given based on specific circumstances.
Chapter 11 Penalties for Violating Life Discipline.
Article 134 Living extravagantly, seeking pleasure, pursuing low-level interests, causing adverse effects, shall result in a warning or serious warning; for severe circumstances, they shall be dismissed from their party positions.
Article 135 Engaging in improper sexual relations with others, causing adverse effects, shall result in a warning or serious warning; for more serious circumstances, they shall be dismissed from their party positions or placed under party observation; for severe circumstances, they shall be expelled from the party.
Using power, educational relationships, subordinate relationships, or other similar relationships to engage in sexual relations with others shall result in heavier penalties.
Article 136 Party members and leading cadres who do not pay attention to family style construction, neglecting the management and education of their spouses, children, and their spouses, causing adverse effects or serious consequences, shall receive a warning or serious warning; for severe circumstances, they shall be dismissed from their party positions.
Article 137 Violating social morals and customs, engaging in improper behavior in public places, causing adverse effects, shall result in a warning or serious warning; for more serious circumstances, they shall be dismissed from their party positions or placed under party observation; for severe circumstances, they shall be expelled from the party.
Article 138 For other serious violations of social ethics and family virtues, a warning up to expulsion from the party shall be given based on specific circumstances.
Part Three Supplementary Provisions.
Article 139 Party committees of provinces, autonomous regions, and municipalities directly under the central government may formulate specific implementation regulations based on these regulations, in conjunction with their actual work.
Article 140 The Central Military Commission may formulate supplementary regulations or specific regulations based on these regulations, in conjunction with the actual situation of the People's Liberation Army and the People's Armed Police Force.
Article 141 These regulations shall be interpreted by the Central Commission for Discipline Inspection.
Article 142 These regulations shall come into effect on October 1, 2018.
For cases that have been closed before the implementation of these regulations, if a review or reconsideration is required, the regulations or policies in effect at that time shall apply. For cases that have not been closed, if the regulations or policies at the time of the act do not consider it a violation, but these regulations do, it shall be handled according to the regulations or policies at that time; if the regulations or policies at the time of the act consider it a violation, it shall be handled according to the regulations or policies at that time. However, if these regulations do not consider it a violation or prescribe a lighter penalty, it shall be handled according to the provisions of these regulations.
